Terms and Conditions of Sale

These terms govern the purchase of the eSIM data plans offered through the VamosData website. By completing a purchase you accept these terms in full. If you do not agree, please do not use the service.
1. Seller identity and subject matter
1.1 These general terms and conditions (the “Terms”) constitute a legally binding agreement between you (the “User”) and Mariano Alberto Lopez Lomas, a sole trader registered in Spain under tax identification number 51077751H, with registered address at Av. Ocho de Marzo 8, 38400 Puerto de la Cruz, Santa Cruz de Tenerife, España, trading as VamosData and contactable at admin@vamosdata.com (“VamosData”, “we” or “us”).
1.2 VamosData sells prepaid mobile data plans in eSIM format for travellers. Profiles are delivered by email and activated on compatible devices.
1.3 These Terms apply together with the Legal Notice, the Privacy Policy and the Cookie Policy, linked at the bottom of this page.
2. Eligibility and account
To make purchases you must be at least 18 or of legal age in your jurisdiction, and provide truthful, up-to-date information during checkout.
If you create a user account, you are responsible for keeping your credentials confidential and for all activity carried out under your account. Notify us immediately at soporte@vamosdata.com if you detect unauthorised access.
VamosData may suspend or cancel accounts with fraudulent or non-existent details, or which breach these terms.
3. Nature of the eSIM service
The eSIMs sold are prepaid data profiles. The service is data-only and does not include voice calls, messaging or emergency services (112, 911, 999, etc.). For emergencies you must use other means available on your device or at your location.
The service is delivered through local operators in each destination country. VamosData acts as a reseller of those plans, not as the network operator providing the service.
The eSIM requires a compatible, carrier-unlocked device. Before buying, you can check whether your model is supported using the device checker on the website.
The device checker is provided for information and guidance only. It is based on information published by manufacturers and is not a warranty or a binding statement that any particular model is compatible: actual compatibility also depends on the software version, the market the handset was bought in, and any lock applied by your carrier. It is your responsibility to make sure, before buying, that your device supports eSIM and is carrier-unlocked; if in doubt, contact us before completing the purchase. None of this affects the legal guarantee of conformity described in section 10, or any other right that consumer law grants you on a mandatory basis.
4. How the contract is concluded
The purchase takes place entirely online and follows these steps:
- You select the destination and data plan you want and, where applicable, the quantity.
- You proceed to the payment gateway, which shows an order summary with the final price before you confirm. On this screen you can change the quantity or go back to correct any error before paying.
- You tick the box accepting these terms, which include the express consent to immediate performance and the acknowledgement of the loss of the right of withdrawal set out in section 9.
- You complete the payment. You then receive the QR code and activation details for your eSIM on screen and by email.
The contract may be concluded in any of the languages the website is available in: Spanish, English, French, German and Polish.
VamosData files the electronic document recording the contract. If you have an account, you can review your orders and retrieve your QR code at any time from the customer area; in all cases a copy of the order is sent to the email address provided.
5. Prices, payment and currencies
Prices shown include applicable indirect taxes unless stated otherwise. The display currency (USD, EUR or GBP) can be selected on the site and is converted using a reference exchange rate; the final charge is processed by our payment provider in the currency shown at checkout.
Payments are processed through Stripe. VamosData does not store or access your full card details. By paying you also accept Stripe’s terms.
The applicable price is the one shown in the order summary at the moment you confirm payment.
6. Activation, validity and expiry
After a confirmed purchase you will receive the QR code and activation details by email. The eSIM must be installed on an unlocked, compatible device. Each plan states on its page when validity begins:
- At the moment of installation (install-activated plans), or
- On first connection to a compatible network (connection-activated plans).
Once validity has started, the plan remains active for the number of days stated on its page, whether or not you use all the data. When the data runs out or the period ends, the plan stops providing service; you can buy a top-up where the plan supports it.
The eSIM must also be installed and activated within the unused-validity period the operator sets for each plan. After that period the profile expires automatically even if no data has been used, with no right to a refund. That period depends on the plan and the destination operator; if you expect not to activate your eSIM within the weeks following the purchase, write to us before buying and we will confirm the applicable period. The commercial refund described in section 10 applies only while the plan is still within that period.
7. Service quality
Coverage, maximum speed and the availability of each network technology depend on the local operator’s network, on your location and on your device. The information published for each plan is the best estimate available, but actual quality may vary due to external factors such as network congestion. VamosData does not guarantee a minimum speed or uninterrupted connectivity.
8. User obligations and misuse
When using the service you undertake to use the eSIMs for personal, non-commercial purposes only, not to resell or redistribute access to the service, and to comply with the laws of the country where you use them as well as with the local operator’s terms.
The following are expressly prohibited:
- Reselling, redistributing or commercialising the service to third parties, as well as traffic arbitrage.
- Using the service in traffic-termination equipment or GSM gateways (SIMBOX).
- Using automated systems that generate continuous or disproportionate traffic, including sustained peer-to-peer (P2P) file sharing.
- Permanent use in a country other than the destination purchased, or usage patterns showing a use other than the temporary, roaming use the service is sold for.
- Any use that infringes third-party rights, applicable law or the terms of the operator providing the connectivity.
VamosData may suspend the service immediately, with no right to a refund, where it detects any of these behaviours or where the operator providing the connectivity reports them to us. Should a suspension turn out to be mistaken, we will restore the service and, where that is not possible, refund the unused portion.
9. Right of withdrawal
Under article 103.m) of Royal Legislative Decree 1/2007 (the Spanish Consumer Protection Act), the 14-day right of withdrawal does not apply to digital content supplied on a non-tangible medium where performance has begun with the consumer’s prior express consent.
By confirming your purchase, you expressly consent to the service beginning immediately and acknowledge that you lose your right of withdrawal once the eSIM QR code has been delivered.
Ticking the box accepting these terms is mandatory in order to complete the purchase, and we keep a record of that acceptance linked to your order. We may deactivate the eSIM profile when processing a withdrawal that does apply.
This exclusion does not affect the rights described in the following section, and in particular the commercial refund of plans that have not been installed or activated.
10. Refunds and the legal guarantee of conformity
Notwithstanding the above, and as a commercial policy that goes beyond the legal minimum, we fully refund any plan that has not been installed or activated and is still within its validity period. Request it by writing to soporte@vamosdata.com quoting your order number.
Once installed or activated, a plan is not refundable on mere withdrawal. It is refundable where the service does not conform to what was purchased.
As a consumer you have the legal guarantee of conformity for digital content and services provided by the TRLGDCU: if the service does not conform to the contract, you are entitled to have it brought into conformity and, where that is impossible or disproportionate, to a price reduction or to terminate the contract with the corresponding refund. This guarantee is unaffected by the loss of the right of withdrawal described in the previous section.
We will process applicable refunds through the same payment method used for the purchase, within a maximum of 14 calendar days from confirming that the refund is due.
11. Warranties and limitation of liability
VamosData will make reasonable efforts to ensure the availability and quality of the service, but cannot guarantee uninterrupted coverage in every location or the absence of occasional failures in local operators’ networks.
To the maximum extent permitted by law, VamosData’s total aggregate liability to the user for any claim arising from the service is limited to the amount actually paid by the user in the three months preceding the triggering event. VamosData is not liable for indirect damages, loss of profit, loss of data or loss of opportunity.
Nothing in this section excludes or limits VamosData’s liability where mandatory consumer protection law does not allow it, nor does it affect the legal guarantee of conformity described in section 10.
12. Complaints and dispute resolution
You may address any complaint to soporte@vamosdata.com or admin@vamosdata.com. We will acknowledge receipt and give you a reasoned reply within a maximum of one month.
If we do not reach a satisfactory solution and you qualify as a consumer, you may turn to the public consumer bodies of your region or municipality, or to the Spanish consumer arbitration boards (Juntas Arbitrales de Consumo). VamosData is not currently a member of any consumer arbitration scheme.
The European online dispute resolution platform ceased operating on 20 July 2025, following the repeal of Regulation (EU) 524/2013 by Regulation (EU) 2024/3228, so complaints can no longer be submitted through it.
13. Data protection
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms. The use of cookies is described in the Cookie Policy.
14. Amendments, applicable law and language
VamosData may amend these terms at any time. Amendments will be published on this page and take effect upon publication. Each purchase is governed by the version in force at the time it is made.
These terms are governed by Spanish law, without prejudice to the mandatory consumer protection rules of the buyer’s country of habitual residence, which apply where they are more favourable to the buyer.
The Spanish version of these terms is the only authentic one. Versions in other languages are courtesy translations; in the event of any discrepancy, the Spanish text prevails.
